HOUSE CONCURRENT RESOLUTION 79

and Stemple)
(Originating in the Committee on Agriculture and Natural
Resources)
Requesting the West Virginia Division of Environmental Protection
to rectify the issues concerning the fishing pond located at
Chief Logan State Park;

Whereas, The fishing pond at Chief Logan State Park has been a
significant recreational facility in the Logan, Lincoln and Boone
County area for several years; and

Whereas, The West Virginia Division of Environmental Protection
entered into an agreement with the West Virginia Division of
Natural Resources to enlarge the fishing pond at Chief Logan State
Park; and

Whereas, The Division of Environmental Protection contracted
with private vendors to design and construct the fishing pond; and

Whereas, Following construction, the Division of Natural
Resources filled the pond and stocked it with fish; and

Whereas, The larger pond quickly became very popular with area
residents; and

Whereas, The Park Superintendent discovered that the pond was
leaking; and

Whereas, The fishing pond has been drained because of the
potential danger; and

Whereas, A civil action was filed by the Division of
Environmental Protection against a vendor, and the action has been
settled through compromise; and

Whereas, There appear to be no plans to repair or improve the
pond at the present time.

Resolved by the Legislature of West Virginia:

That the Division of Environmental Protection make every
reasonable effort to correct the problems with the fishing pond at
Chief Logan State Park in a timely manner; and, be it

Further Resolved, That the Division of Natural Resources
provide any required assistance or cooperation, and report to the
Legislature on the status of the fishing pond no later than the
first day of the two thousand two regular legislative session; and,
be it

Further Resolved, That the Clerk of the House of Delegates
forward copies of the resolution to the Director of the Division
of Environmental Protection, to the Director of the Division of
Natural Resources, and to the co-chairs of the Parks and Recreation
Committee of the Legislature.
